It turns out according to TMZ today, that Kristin Cavallari was not the one who filed for divorce first for all her listed reasons in severing the marriage, it was Jay Cutler who beat Kristin to it just days before siting irreconcilable differences, claiming also to be the at-home parent who was the primary caregiver of the kids, Kristin more than anything was surprised that Jay went first out of the gate, leading Kristin to go on the defensive when filing her divorce petition.
One point to learn and keep in mind about divorce in Tennessee is the “fault state” option, someone filing for divorce must show fault on the part of the other spouse, being why Kristin claimed marital misconduct against Jay, it’s more of a tactic than anything in the divorce proceedings before finally coming to a final resolution with both parties.
